The country`s largest Internet portal, Daum Communications Corp., launched a 10 billion won ($9 million) antitrust lawsuit against Microsoft yesterday, demanding that the U.S. software giant exclude the Windows Messenger software from its Windows XP operating system.
"Microsoft continues to abuse their market dominance in computer operating systems by bundling the Windows Messenger into their Windows XP software, which apparently is a violation of antitrust law. Daum Communications suffered significant losses with its instant messaging services due to Microsoft`s unlawful actions," said the company in the lawsuit filed with the Seoul Central District Court against Microsoft and its Korean branch Microsoft Korea.

Daum`s lawsuit is an extension of its 2001 complaint filed with the Fair Trade Commission, when the company first protested the bundling of Messenger with Windows XP. The FTC has not yet made a ruling on the issue.

"We believe that the legal actions against Microsoft`s antitrust violations would help recover fair competition in the local industry, where Internet portals such as Daum and other software companies have suffered under a disadvantage," said Park Hyun-jeong of Daum`s public relations bureau.

Company officials declined to release the details of the financial losses they claim in the lawsuit.

Microsoft Korea did not release an official response to Daum`s lawsuit yesterday.

Microsoft first bundled Windows Messenger into its Windows XP operating system in June 2001 to tighten the integration between instant-message software and operating system, in order to give them a competitive edge over competitors such as AOL Time Warner of the U.S., whose AOL Instant Messenger service gained worldwide popularity.

Microsoft had already been providing instant-message services with their MSN Messenger program, which could be downloaded online.

The software giant used similar tactics to success in the past, such as when they linked Internet Explorer with Windows 95 and dominated the Web-browsing software market. Daum has been offering its instant-message services since 2000.

The lawsuit comes less than a month after the European Commission fined Microsoft for a record 497 million euros ($600 million) for antitrust violations and ordered them to exclude Windows Media Player from their Windows operating system and make available some of the operating system`s source code. Microsoft is expected to appeal against the commission`s ruling.

Daum is the country`s largest Internet portal with more than 35 million subscribers. The company reported more than 141 billion won in reveune last year.

다음, 불공정거래로 MS에 손배소 제기

한국 최대의 인터넷 포털인 다음커뮤니케이션은 윈도우 XP 운영체제에서 윈도우 메신저 프로그램을 제외시킬 것을 요구하며 어제 미국의 소프트웨어 거인인 마이크로소프트사가 공정거래법을 위반했다는 이유에서 100억원(900만불)의 손해배상 청구소송을 냈다.

�마이크로소프트사는 윈도우 메신저를 윈도우 XP 소프트웨어에 끼워 파는 식으로 컴퓨터 운영체제에서의 시장지배적 위치를 남용해 온 것은 명백한 공정거래법 위반이다. 다음커뮤니케이션은 마이크로소프트의 부당한 행위로 인해 자사의 메신저 서비스에 막대한 손실을 입었다�고 동사는 마이크로소프트사와 한국지사인 마이크로소프트 코리아를 상대로 서울중앙지방법원에 낸 소장에서 밝혔다.

다음이 소송을 건 것은 윈도우 XP에 메신저를 끼운 것에 대해 2001년에 공정거래위원회에 처음 제소한 이후 계속 이어지고 있는 것이다. 공정위는 이 문제에 대해 아직 심판을 내리지 않고 있다.

�마이크로소프트사의 불공정행위에 대한 소송으로 다음을 비롯한 인터넷 포털과 기타 소프트웨어 회사들이 불리한 위치에서 손해를 보고 있는 국내 업계에 공정한 경쟁이 회복될 것으로 믿는다�고 다음 홍보부의 박현정씨가 말했다.

동사 직원들은 소장에서 주장한 자신들의 금전적 손실의 구체적인 내역은 밝히기를 거부했다.

어제 마이크로소프트 코리아는 다음의 소송에 대한 공식반응을 밝히지 않았다.

마이크로소프트사는 당초 메신저 서비스로 세계적인 인기를 얻고 있던 미국의 AOL 타임워너사 등과 같은 경쟁업체와의 사이에서 우위를 확보하기 위해 메신저 서비스와 운영체제간의 통합을 강화해 2001년 6월에 윈도우 XP에 윈도우 메신저를 묶음으로 포함시켰다.

마이크로소프트사는 당시 인터넷에서 다운로드 받을 수 있는 MSN 메신저 프로그램을 통해 메신저 서비스를 이미 제공하고 있었다.

이 소프트웨어업계의 거인은 인터넷 익스플로러를 윈도우 95에 연결시켜 웹브라우징 소프트웨어 시장을 지배하는 등 과거에도 유사한 전략을 구사해 성공을 거두기도 했다. 다음은 2000년부터 메신저 서비스를 제공해 오고 있다.

이번 소송은 유럽위원회가 마이크로소프트사에 불공정거래 위반으로 사상최대 금액인 4억 9700만유로(6억불)의 벌금을 부과하고 윈도우 미디어 플레이어를 윈도우 운영체제에서 제외할 것과 운영체제의 일부 소스코드를 공개할 것을 명령한지 한달도 채 되지 않은 시점에서 일어난 것이다. 마이크로소프트사는 유럽위원회의 판결에 항소할 것으로 보인다.

다음은 한국 최대의 인터넷 포털로 3,500만명이 회원으로 가입해 있다. 동사는 지난 해에 1,410억원의 매출을 발표하기도 했다.
